Non-Exclusive Kit License

This Non-Exclusive Kit License is the agreement between you and xyvoss for each drum kit, loop kit, or similar non-exclusive sample pack you purchase or download from xyvoss.com (each, a "Kit").

By completing checkout for a Kit, or by downloading or using Kit files, you confirm that you have read and agree to this license, the Terms of Service, and the Privacy Policy.

This license does not apply to exclusive loops. Exclusive loops are governed by the separate Exclusive Loop License.

1. Nature of the license

Kits are sold on a non-exclusive basis. The same Kit may be sold to other customers. Purchase of a Kit does not transfer ownership of the underlying sounds, recordings, or intellectual property to you. xyvoss retains all ownership rights in the Kit, subject only to the limited license granted below.

2. Permitted use — non-commercial and non-profit

Subject to the restrictions in this license, xyvoss grants you a worldwide, non-exclusive, non-transferable license to use the sounds and samples included in the Kit free of additional royalties for non-commercial and non-profit purposes only.

Examples of permitted non-commercial or non-profit use include:

• Personal practice, learning, demos, and private projects that are not sold or monetized.
• Non-profit educational projects, school work, or community projects that are not operated for profit.
• Unpaid creative work shared without charging listeners, viewers, or clients for access, and without generating advertising, streaming, or sync revenue from the work that incorporates Kit sounds.

In these cases you may edit, process, arrange, and combine Kit sounds with your own material to create finished musical or audiovisual works, provided those works remain non-commercial and non-profit as described above.

3. Commercial or for-profit use — contact required

If you intend to use Kit sounds in any commercial or for-profit context, you must contact xyvoss and obtain written permission (or a separate commercial license) before that use begins.

Commercial or for-profit use includes, without limitation:

• Releasing, selling, or monetizing music, beats, or other content that incorporates Kit sounds (including paid downloads, streams, or sales).
• Using Kit sounds in work commissioned by a client, label, brand, or other paying party.
• Sync or placement in advertisements, films, games, apps, or other media where you or a third party receives payment or commercial benefit.
• Any use that generates advertising revenue, sponsorship income, or other profit connected to the work containing Kit sounds.

Until xyvoss has agreed in writing to commercial terms for your use, you do not have a license for commercial or for-profit exploitation of Kit sounds.

4. What you may not do

Whether your use is non-commercial or commercial, you may not:

• Resell, re-license, rent, or redistribute the Kit ZIP file, individual samples, or stems as a sample pack, sound library, loop pack, or competing product.
• Upload or share the raw Kit files on public download sites, torrents, or sample-sharing platforms for others to take.
• Claim that you created the Kit sounds as a standalone product separate from your own finished works that incorporate them.
• Use Kit sounds in any unlawful manner, or in a way that infringes third-party rights beyond the Kit itself (for example uncleared vocals or samples you add later — those remain your responsibility).

5. Credit

Crediting xyvoss (for example "Kit sounds by xyvoss") is appreciated but not required for permitted non-commercial or non-profit use, unless a specific product listing states otherwise. Commercial clearances may include credit or other conditions as agreed in writing.

6. Delivery, payment, and refunds

Prices are shown in USD unless stated otherwise. Payments are processed by Stripe. You are responsible for any applicable taxes.

Delivery is complete when download access is made available on the checkout success page and/or by email. Download links may expire. You are responsible for downloading and safely storing your files. For verified purchases, xyvoss may assist with lost-file recovery when reasonable.

Because Kits are digital downloads, sales are generally final and non-refundable once download access is provided, except where applicable law requires otherwise. If a file is defective or undeliverable, contact xyvoss for a replacement before initiating a chargeback.

7. Warranties and liability

To xyvoss's knowledge, xyvoss has the right to grant the non-exclusive rights described in this license for the Kits offered on xyvoss.com. Kits are otherwise provided "as is." xyvoss does not guarantee commercial success, playlist placement, or any other result from using Kit sounds.

To the fullest extent permitted by law, xyvoss's total liability arising from any Kit purchase or this license is limited to the amount you paid for that Kit. xyvoss is not liable for indirect or consequential damages.

8. Changes

xyvoss may update this license for future Kit sales. The version that was in effect when you purchased or first downloaded the Kit applies to that purchase. Material updates will be reflected in the "Last updated" date on this page.
